Administrative Architecture of Provincial (Gubnoye) Governance Bodies According to the New Code Book of the Early 18th Century

The importance of studying legislative monuments, including those created in the course of the work of various commissions on drafting a new code, was emphasized due to the casuistic and pragmatic nature of Russian law. Chapter XXI, “On Robbery and Theft Cases,” of the New Law Code Book of the early 18th century has been studied. This book was the result of the codification work of the Chamber for the Law Code, although it did not acquire legal force. The heuristic potential of this source is noted, as it represents a legal cross-section of gubnoye law and the structure of local administrative bodies involved in combating criminal offenses prior to the fundamental reforms of Peter I in the sphere of local governance. The norms regulating gubnoye affairs in this source are compared with earlier legal acts — the Council Code of 1649 and the New Decree Articles of 1669. It is demonstrated that the legislator did not intend to abolish the system of gubnoye institutions. It is concluded that the years 1701–1702 are mistakenly regarded by many researchers as a bifurcation point in the development of gubnoye administration.
